Welcome to Lifevate!
These Terms of Service ("Terms") govern your use of the Lifevate AI-powered habit-tracking application and website at https://lifevate.top (collectively, the "Service"). By creating an account or using our Service, you agree to be bound by these Terms.
Please read these Terms carefully before using Lifevate. If you do not agree to these Terms, you may not access or use the Service.
1. Description of Lifevate
Lifevate is an AI-powered habit-tracking application designed to help users build lasting positive habits through intelligent personalization, social motivation, and privacy-first design. Our Service includes:
- AI-powered habit recommendations based on your schedule and preferences
- Smart, context-aware reminders that adapt to your availability
- Social challenges and leaderboards to build habits with friends
- Progress tracking, analytics, and data export capabilities
- Life Feed: Personalized daily content to inspire and educate
- Creator Marketplace for habit templates and packs (when available)
2. Eligibility
To use Lifevate, you must:
- Be at least 13 years of age (or the minimum age required in your jurisdiction)
- Have the legal capacity to enter into a binding agreement
- Not be prohibited from using the Service under applicable laws
If you are under 18, you represent that you have reviewed these Terms with your parent or legal guardian and they have agreed to these Terms on your behalf.
3. Account Registration & Security
Creating an Account:
- You must provide accurate, complete, and current information
- You are responsible for maintaining the confidentiality of your account credentials
- You agree to notify us immediately of any unauthorized access to your account
- One person or legal entity may not maintain more than one free account
Account Security:
- You are responsible for all activities that occur under your account
- Choose a strong password and do not share it with others
- We are not liable for any loss or damage arising from your failure to maintain account security
Account Termination:
- You may delete your account at any time through the app settings
- We may suspend or terminate your account if you violate these Terms
- Upon termination, your access to the Service will cease immediately
- Your data will be permanently deleted within 30 days of account deletion
4. Subscription Plans & Billing
4.1 Free Trial
- New users receive a 7-day free trial of Premium features
- No credit card required to start the trial
- You may cancel anytime during the trial period without charge
- If you do not cancel before the trial ends, you will be charged for your selected plan
4.2 Subscription Plans
We offer the following subscription plans:
- Monthly Plan: $9.99/month
- Yearly Plan: $79.99/year (save 33%)
- Pro Plan: $119.99/year
All prices are in USD and subject to applicable taxes.
4.3 Billing & Automatic Renewal
- Subscriptions automatically renew at the end of each billing period
- Your payment method will be charged automatically unless you cancel
- Cancellation must occur at least 24 hours before the renewal date
- Price changes will be communicated at least 30 days in advance
- You will have the option to cancel if you do not accept the new pricing
4.4 Payment Processing
- All payments are processed securely through Stripe
- By providing payment information, you authorize us to charge your payment method
- You are responsible for ensuring your payment information is current and accurate
- Failed payments may result in suspension of Premium features
4.5 Refund Policy
- Subscriptions may be refunded within 7 days of initial purchase
- Refunds are provided on a case-by-case basis for billing errors

- Refunds are processed to the original payment method within 5-10 business days
- Abuse of the refund policy may result in denial of refunds or account termination
4.6 Cancellation
- You may cancel your subscription anytime through account settings or by contacting support
- Cancellation takes effect at the end of the current billing period
- You will retain access to Premium features until the end of the paid period
- No refunds are provided for partial billing periods unless required by law
5. User Content & Conduct
5.1 Your Content
You retain ownership of all content you create, including:
- Habits you track and notes you add
- Messages sent in challenge group chats
- Custom habit templates you create
- Data you generate through using the Service
By using the Service, you grant us a limited license to:
- Store and display your content within the Service
- Process your content to provide features (e.g., AI recommendations)
- Share content you explicitly choose to make public (e.g., challenge progress)
5.2 Prohibited Content & Conduct
You agree not to:
- Post content that is illegal, harmful, threatening, abusive, or offensive
- Harass, bully, or intimidate other users
- Impersonate any person or entity
- Share content that infringes on intellectual property rights
- Attempt to gain unauthorized access to the Service or other user accounts
- Use the Service for any illegal or unauthorized purpose
- Transmit viruses, malware, or other malicious code
- Scrape, data mine, or use automated tools to access the Service
- Reverse engineer or attempt to extract source code from the Service
- Share your account credentials with others
Violation of these prohibitions may result in immediate account termination and legal action.
5.3 Content Moderation
We reserve the right to:
- Review, monitor, and remove content that violates these Terms
- Suspend or terminate accounts that engage in prohibited conduct
- Investigate suspected violations and cooperate with law enforcement
We are not obligated to monitor user content but may do so to ensure compliance with these Terms.
6. Social Features & Challenges
6.1 Challenges
- When you create or join a challenge, your name and progress are visible to participants
- You are responsible for interactions in challenge group chats
- We may remove challenges or messages that violate our community guidelines
- Challenges are user-generated and we are not responsible for challenge content
6.2 Community Guidelines
When participating in social features:
- Be respectful and supportive of other users
- Do not share personally identifiable information about others
- Do not use challenges for commercial solicitation
- Celebrate others' progress and maintain a positive environment
7. Intellectual Property
7.1 Lifevate's Intellectual Property
All intellectual property rights in the Service, including:
- The Lifevate name, logo, and branding
- The software, code, and algorithms
- The user interface and design
- AI models and recommendation systems
- Content created by Lifevate (e.g., Life Feed articles)
are owned by Lifevate or our licensors. You may not copy, modify, distribute, or create derivative works without our written permission.
7.2 Limited License
We grant you a limited, non-exclusive, non-transferable, revocable license to:
- Access and use the Service for personal, non-commercial purposes
- Download the mobile app on devices you own or control
This license terminates upon your termination of the Service or violation of these Terms.
7.3 Feedback
If you provide feedback, suggestions, or ideas about the Service:
- You grant us an unlimited, irrevocable, perpetual, worldwide license to use such feedback
- We are not obligated to compensate you for feedback
- We may implement or ignore feedback at our sole discretion
8. Data Export & Portability
You may export your data at any time:
- CSV export of all habit tracking data
- JSON export of complete account data
- Notion integration for automatic syncing
- Upon request, we will provide a complete data archive
We support data portability to ensure you are never locked into our Service.
9. Privacy & Data Protection
Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy, available at https://lifevate.top/privacy-policy.
Key privacy commitments:
- We never sell your personal data
- You control what data you share with other users
- Data export and deletion available anytime
- Optional local-only mode for complete privacy
- End-to-end encryption available for synced data
By using the Service, you consent to our Privacy Policy.
10. AI Features & Accuracy
10.1 AI-Powered Recommendations
Our AI features provide personalized suggestions, but:
- AI recommendations are suggestions, not medical or professional advice
- You should use your own judgment when adopting recommended habits
- AI accuracy improves over time but is not perfect
- We are not liable for decisions made based on AI recommendations
10.2 Data Processing
AI features may process:
- Your calendar data (if you opt in)
- Your habit completion patterns
- Your interactions with Life Feed content
- Aggregated, anonymized data from all users to improve models
All AI processing respects your privacy settings and data permissions.
11. Third-Party Services
The Service integrates with third-party services:
- Stripe for payment processing
- Google OAuth for authentication (optional)
- Notion for data export (optional)
- Calendar providers for smart scheduling (optional)
Your use of third-party services is subject to their respective terms and privacy policies. We are not responsible for third-party services' practices or availability.
12. Disclaimers & Limitations of Liability
12.1 No Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability, fitness for a particular purpose, or non-infringement
- Warranties that the Service will be uninterrupted, secure, or error-free
- Warranties regarding the accuracy or reliability of content or AI recommendations
12.2 Health & Wellness Disclaimer
Lifevate is a habit-tracking tool, not a medical device or healthcare service:
- We do not provide medical, mental health, or professional advice
- Consult healthcare professionals before starting new health-related habits
- If you experience medical issues, seek professional medical attention
- We are not liable for injuries, health issues, or damages resulting from habit changes
12.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LIFEVATE SHALL NOT BE LIABLE FOR:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Damages resulting from unauthorized access to your account
- Damages from third-party services or user-generated content
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so these limitations may not apply to you.
13. Indemnification
You agree to indemnify, defend, and hold harmless Lifevate, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your violation of these Terms
- Your use of the Service
- Your content or conduct
- Your violation of any third-party rights
14. Changes to the Service
We may:
- Add, modify, or remove features at any time
- Change pricing with 30 days' notice
- Suspend the Service for maintenance or updates
- Discontinue the Service entirely with 90 days' notice
We will make reasonable efforts to notify you of significant changes, but are not obligated to do so for minor updates.
15. Updates to These Terms
We may update these Terms from time to time. When we make changes:
- The "Last Updated" date will be revised
- We will notify you via email or in-app notification
- Significant changes will be announced at least 30 days in advance
- Your continued use of the Service after changes take effect constitutes acceptance
If you do not agree to updated Terms, you must stop using the Service and may delete your account.
16. Governing Law & Dispute Resolution
16.1 Governing Law
These Terms are governed by and construed in accordance with the laws of France, without regard to conflict of law principles.
16.2 Dispute Resolution
In the event of a dispute:

- If informal resolution fails, disputes will be resolved through binding arbitration or small claims court
- Arbitration will be conducted in accordance with the rules of the applicable arbitration authority
- You waive your right to participate in class action lawsuits
16.3 Jurisdiction
You agree to submit to the personal jurisdiction of courts located in France for any disputes that are not resolved through arbitration.
17. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.
18. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Lifevate regarding the Service and supersede all prior agreements, understandings, and communications.
